COMMISSIONERS’S MEETING

This is to certify the following is a true and correct copy of the Broadwater County Commissioner Minutes approved by the Commissioners on October 17, 2005.

SEPTEMBER 19, 2005

The meeting of the Broadwater County Commissioners was called to order by chairman James V. Hohn. Present were Commissioner Steven R. McCullough and Commissioner Elaine M. Mann.

Vicki Marquis cancelled her meeting she scheduled with the Commissioners.

Natalie Tomeo, brought to the Commissioners the FY 05/06 PILT requests. Commissioner McCullough made a motion to accept the PILT requests; Commissioner Mann seconded the motion, the motion passed unanimously. (See Attachment)

Julie Lethert met with the Commissioners to discuss Grace Hopper’s plat for final approval. Commissioner McCullough made a motion to give final approval for Grace Hopper’s plat, Commissioner Mann seconded the motion, and the motion passed unanimously.

Travis Ricktmeyer met with the Commissioners to discuss getting a septic permit to use an ally easement for his well. Present for this meeting was Travis Ricktmeyer, Melissa Tuemmler, Carrie Giomi, Julie Lethert, Nichole Brown, Jenny Schauber, and Mr. and Mrs. Harris. The Harris’ are here to object to closing the alley, however Commissioner McCullough stated the alley is already closed but the un-obstruction rule still applies. Mrs. Harris said their plat shows the alley as an open alley. Julie Lethert, the County Sanitarian stated that the Commissioners minutes in October 2, 1996 show that a public hearing was held regarding the closure of the alley in the Springville Subdivision. The approval to close the alley way was granted and recorded in the October 22, 1996 minutes. The Commissioner will table this decision until they receive a map to scale showing drawings of the property and the well. (See Attachment)

John Flynn, County Attorney, met with the Commissioners to discuss Eustis Road. Mr. Flynn said parties involved are negotiating a solution.

Tim Pool, County Sanitation Department, told the Commissioners the improvement cost to the Winston transfer site is estimated at around $30,000 to $35,000 and he suggested getting two more cans for construction material coming in to the transfer site which would be an additional cost of $16,000 to $17,000 so we would be looking at around $50,000.

Commissioner Hohn suggested getting someone to state work right away and because the estimate is $30,000 for the construction improvement at the transfer site Tim Pool does not have to advertise for bids, however the Commissioners suggest that he does contact local construction companies for the construction work.

Tim Pool would also like to have the county road crew help with the excavation to reduce the cost. Commissioner Hohn suggested that he talk to Bob Masolo, County Road Foreman, regarding that issue. Commissioner Hohn also suggested that Mr. Pool contact Norman Bruce in Twin Bridges for the new cans. Mr. Pool suggested possibly using the school to help build smaller cans. Commissioner Hohn told Mr. Pool he could look into that possibility.

Finally, Mr. Pool told the Commissioners he took over use of the motion camera from the Sheriff’s office used out at the transfer site used to catch violators. He has bought a new computer that allows him to download pictures of violators and then he can give that information over to the sheriff’s office.

Jerry Wells met with the Commissioners to discuss what has been going on since the last time he met with the Commissioners, three years ago, regarding the Rocky Mountain Elk Foundation, Iron Mask Land Acquisition. He asked for the Commissioners to write a letter of support. (See Attachment)

Mail/Items for discussion, action and/or signature

Natalie Tomeo brought to the Commissioners attention a new Afflac vision policy, Commissioner Mann motioned to make the new vision policy from Aflac a part of the County’s benefit package, as an option to the employee, Commissioner McCullough seconded, and motion was carried.

The Commissioners approved transferring $169,385.20 from District Court to General Fund.

The Commissioners signed The Department of Justice’s request to have the Commissioners to sign the County Attorney Salary for FY 2006 between state and county.

Jim Holland Sr. has resigned from the Airport Board; Commissioner Hohn suggested that the County Commissioners take over the Airport responsibilities temporarily.

Natalie Tomeo will write up a thank you letter to Jim Holland Sr. for his work as chairman of the Airport Board and she will send a letter to the airport board regarding the resignation and vacancy of Mr. Holland
Ernie Carlson sent in a letter of interest for the Airport Board vacancy, however this maybe a conflict of interest.

Sean Moss sent a letter regarding his property, he has met with the County Sanitarian and is in the process of a one lot split minor subdivision. He is requesting the commissioners waive the requirement of an environmental assessment and a public hearing. Commissioner McCullough motioned to waive the requirement of an environmental assessment and public hearing for Mr. Moss; Commissioner Mann seconded the motion and the motion carried. The Commissioners approved using excavated material to level and improve property at the Canyon Ferry Airport to bring up to grade and relocate the fence where it is supposed to be, at the Trust Board’s expense.

The Commissioners received a petition from Joe Dixson regarding Dunbar Road. Mr. Dixson would like Dunbar Road to become a county road.

The Commissioners asked Natalie to have Judy Gillespie’s office verify that the names on the petition are correct.

Commissioner Mann brought in a resolution to create a budget for the Mental Health Board, however Commissioners McCullough said he would rather see funds requested for the Mental Health Board in the form of a PILT request instead of creating a budget. Commissioner Hohn concurred?

The Commissioners approved an extension on the Crow Creek Valley Grant for Pam Converse, County Weed Coordinator.

The Commissioners received a letter from BCDC regarding economic development in Broadwater County and Virginia Knerr. They would also like to schedule a meeting with the Commissioners to discuss economic development issues.

The Commissioners approved the Governor’s Work Force Training Plan, "Agreement on Single Statewide Regional Planning Area". (See Attachment)

There were no claims or payroll to approve.

The meeting was adjourned at 3:30 pm, the next Commissioners meeting is scheduled for September 26, 2005 at 10:00am in the Commissioners room in the Courthouse.
