COMMISSIONERS’S MEETING

This is to certify the following is a true and correct copy of the Broadwater County Commissioner Minutes approved by the Commissioners on October 17, 2005. Judy R. Gillespie, Clerk

SEPTEMBER 26, 2005

The meeting of the Broadwater County Commissioners was called to order by chairman James V. Hohn. Present were Commissioner Steven R. McCullough and Commissioner Elaine M. Mann.

Bob Masolo, County Road Department Foreman, met with the Commissioners to update them on the work his department has done. They are finishing up on grading and maintenance and the signs are up in Radersberg, Toston, and Springville.

Bob will be putting in an advertisement regarding the county grader for bids, as trade-in. He will leave a packet of information for those interested in the county finance officer’s office.

Morrison and Maierle, Inc. are putting a proposal together regarding the petition for Dunbar Road and estimates for the impact fee program.

Bob said he has received a complaint regarding the cattle guard on Dry Gulch. The Commissioners want a letter sent to Mr. England to either fix or remove the cattle guard.

Terry Frost called Bob Masolo, regarding his subdivision roads. Bob said the roads are not up to county specifications.

The Commissioners want to see the current policy for a car gate (cattle guard), the 30-day requirements adjust to 10 days. Also for emergency reasons, the Commissioners want the road foreman to have authority to remove or fill in cattle guards and their needs to be a requirement for a pass gate, unless variance issued by the County Commissioners.

The Commissioners want the Road & Bridge encroachment permits updated.

Bill Fleiner, DES Coordinator, Commissioners Interoperable Communication Radios, he asked the Commissioners if they wanted encrypted capability, the Commissioners said at this time no they do not need this capability.

Bill said the project is moving along very well and will be getting project estimates in.

Bill would like to get prison industry to build communication towers because the grant does not include construction cost. All we would have to do is pay for material. This would decrease cost significantly.

Tim Ravndal, Montana Multiple Use Association, met with the Commissioners to discuss the roadless rule and the North Belt Travel Plan. Mr. Ravndal told the Commissioners that the North Belt Travel Plan issues were denied when appealed.

Mr. Ravndal wants the Commissioners to adopt Roadless Area Task Force resolution that he prepared. Mr. Ravndal wants the Commissioners blessing to move forward on whites Gulch Road issues with forest Service.

Travis Richtmeyer met with the Commissioners regarding use of easement for a septic permit for a well. After discussions with the County Sanitarian, the County Commissioners approved Travis Richtmeyer’s request. The Commissioners asked Natalie to write a letter to Mr. Richtmeyer as to their decision and send a copy of the letter to the County Sanitarian.

Larry Richtmeyer sent a letter to the Commissioners requesting a variance to allow him to drill a well approximately 92 feet from his proposed drainfield. (See Attachment)

After a discussion Commissioner McCullough motioned to approve the variance,

Commissioner Mann did not second the motion, the deciding vote went to Commissioner Hohn who did second the motion and the motion was carried.

Jenny Schauber, Schauber Surveying, met with the Commissioners regarding White Horse Road. Mrs. Ravndal will prepare a petition to make White Horse Road a public road for the part not included in the 1917 public hearing and petition with Jenny Schauber’s help. (See Attachment)

Julie Lethert. met with the Commissioners to discuss Preliminary Plat Approval for Canal Properties Minor. However, the owner of the Canal Properties Minor questioned item 6 in the "Finding of Facts". He felt this should me removed from the finding of facts.

Commissioner McCullough motioned to accept the preliminary plat for approval as presented however, striking item 6. Commissioner Mann seconded the motion and the motion passed unanimously. (See Attachment)

Duane Halverson, Airport Board Chairman, met with the Commissioners regarding the pilot septic system. There was some damage done during the project and Mr. Halverson asked the Commissioners to approve a contract change for order # 2 for the fuel project of $400.00.

Commissioner McCullough, spoke not as a Commissioner but as a private citizen, regarding residential hangers, he suggested asking to Ernie Carlson to change the location of his hanger. Commissioner Hohn suggested sending a letter of cease and desists and send a copy of the letter to County Attorney, John Flynn.

Joe Dixson and his attorney, met with the Commissioners regarding the petition for Dunbar Road. The Commissioners explained that at this time, no decision has been made on Dunbar Road.

Mail/Items for discussion, Action and/or Signature

The Commissioners signed Virginia Knerr’s grant. (See Attachment)

The Commissioners signed Linda Campbell’s Bio-Terrorism Contract (See Attachment)

The Commissioners approved Motor Vehicle Reports.

The Commissioners approved the claims for September 19, 2005 in the amount of $67,254.02.

The Commissioners approved the Payroll for September 08, 2005 in the amount of $85,166.75.

Inter-local agreement from John Flynn regarding Judge Gary Olsen & the City Judge to merging both the City and County Courts. The Commissioners suggested putting on the next agenda.

The Commissioners waived the penalty and interest for Rick Robertson and Richard Berg’s property taxes. (See Attachment)

The Commissioners want a copy of the First Premiere letter regarding the investment policy that the Trust Board has been waiting for.

Ben Sauter sent a letter to the Commissioners requesting a waiver, for his subdivision regarding the requirements of a preliminary road design. The Commissioners denied this request.

The Commissioners received a letter of interest from Don Thompson for the Airport Board, the Commissioners asked Natalie to set up a meeting.

There were no Public Comments

The meeting was adjourned at 3:30 pm, the next Commissioners meeting is scheduled for October 3, 2005 at 10:00am in the Commissioners room in the Courthouse.
