MINUTES OF COMMISSIONER’S MEETING

June 26, 2006                                                                                                             

 

 

 

Chairman Steven R. McCullough called the regular meeting of the Broadwater County Commissioners to order.  Commissioner James V. Hohn and Commissioner Elaine M. Mann were present.

 

Bob Masolo, Road Foreman, reported on the Road Department’s activities as follows:

 

Commissioner Mann moved to approve the Commissioner minutes of June 12, 2006 and June 19, 2006 with corrections.  Commissioner Hohn seconded the motion.  The motion passed unanimously.

 

Commissioner Hohn moved to approve the Special Commissioner’s Minutes held on June 12, 2006 for the canvassing of the Primary Election.  Commissioner Mann seconded the motion.  The motion passed unanimously.

 

Beth Ihle of the Forest Service appeared before the Commissioners to update them on the Bike Path Project.  She informed them that a $10,000 grant was submitted by the Trust Board and that the County’s commitment to the project was gravel.  The Trust Board has committed a 20% match which equals $2200.  The County will pay the bills as they come in and then submit those bills to the Fish Wildlife and Parks for reimbursement.  Beth questioned who would manage the grant, handle the bid and over see the contract with the Contractor.  The Commissioners stated that the County would be responsible for handling those tasks.  Beth advised the Commissioners that a encroachment permit would have to be applied for by the County. She will prepare the permit but needs the approval of the Commissioners.  Commissioner Hohn moved to approve the application of the encroachment permit.  Commissioner Mann seconded the motion.  The motion was unanimous.   Beth noted that this first phase of the project is 1.2 miles north of the River Bridge.  A discussion on what could be done regarding the bike path across the River Bridge.  At this point, the Montana Department of Transportation does not have any plans to put an addition on to the Bridge to accommodate a bike path.  A grant for Phase II of the project will be submitted next Friday.  The Trust Board is the applicant. Phase II will connect to Phase I and include repairs to the old Frontage Road to the Silos Road. Beth asked the County if they would be willing to donate and haul gravel.  She asked if a culvert could also be donated.  The Commissioners told her that should not be a problem.

 

Commissioner Mann moved to cancel the regular scheduled Commissioner’s meeting of July 3, 2006.  Commissioner Hohn seconded the motion.  The motion was passed unanimously.

 

Nichole Brown, Secretary to the Planning Board, presented the application of Robert Cobban for final plat approval of Muffley Estates Major no. 2 Subdivision.  Mrs. Brown read the Order and the conditions for final plat approval.  A letter from Leslie Heisey of the Fire Board was submitted.  It stated their concern about not having a potable water supply in the area.  Commissioner Mann questioned why there was no information on the drainfields.  The Commissioners explained that these were 20 acre lots so they don’t have to have test plots.  Commissioner Mann stated that the overhead power line should have an easement on the plat.  Commissioner Mann asked about a covenants regarding 1990 or newer single or double wide homes.  The Commissioners reminded her that the County does not have building codes.  The dates should be changed or amended on the completion of the weed plan.  The well needs to state that it is a “working well”.  The approval failed until corrections are made.

 

Nichole Brown told the Commissioners that the plat for Colter’s run has not been filed and asked if it could be before the corrections.  The Commissioners said “No”.

 

11:45 a.m. is the time schedule for the public hearing on the Expenditure and Revenue Budget Amendments.  Natalie Tomeo, Finance Officer, presented the Commissioners with a listed of proposed amendments.  There were no public comments and the hearing was closed.  Commissioner Hohn moved to approve the Budget amendments as listed.  Commissioner Mann seconded the motion.  The motion passed unanimously.

 

The meeting was adjourned for lunch at noon and reconvened at 1:30 p.m.

 

Judy Rockwell, acting as the spokesperson for a group of Broadwater County Citizens in attendance of the meeting, appeared before the Commissioners.  She asked the Commissioners to implement zoning in our County for sexually oriented businesses.  She told the Commissioners that Yellowstone County has passed an emergency interim zoning that is good for 1 year.  The group wants the Commissioners to set up a public hearing and start the legal process before any business can open.  The group heard that the Silo’s Inn might become one of these types of businesses.  Brian Obert of Gateway Economic Development assured Mrs. Rockwell and the group that the Silo’s Inn was not becoming one of these types of business.  It was only a rumor and the owner of the Silo’s has no intention of turning the business into a SOB.  The Commissioners told the group that they will give the information to the County Attorney and that they would wait for his advice. 

 

Century Construction Company sent the Search and Rescue a bill in the amount of $7000.  The Commissioners asked Natalie Tomeo, Finance Officer, to contact the Search and Rescue to see what work was done for that amount.

 

Bill Burkland of Peccia and Associates was unable to attend the meeting but faxed information regarding the Airport to the Commissioners.

 

The Weed Board has asked the Commissioners for approval of NAPA’s Auto Parts line of Credit.  Commissioner Hohn moved to approve the line of credit.  Commissioner Mann seconded the motion.  The motion passed unanimously.

 

Commissioner Hohn moved to approve the claims of June 21, 2006 in the amount of $121, 012. 02.  Commissioner Mann seconded the motion.  The motion passed unanimously. 

 

Bob Masolo, Road Supervisor, reappeared before the Commissioners.  His research indicated that Shaffer Lane is a County Road.  The Commissioners will write a letter to the owner of the equipment asking him to remove the equipment from the road and easement.

 

The Commissioners discussed the budget of the County Sanitarian for FY 2006-2007.

Julie Lethert, County Sanitarian, prepared her budget based on her position being a full time position and hiring a half time position.  The salary line item would amount to $68,000 per year.  Commissioner Mann stated that with all the tasks and responsibilities that the Sanitarian held that it should be a ¾ position.  Commissioner Mann moved to give her a position and salary for a 32 hours work week.  Commissioner Hohn seconded the motion.  The motion carried.  Chairman McCullough voted against the motion.

 

Mail/items needing approval and signature:

§         A bill from WWC was presented to the Commissioners for their approval.  The Commissioners approved it.

§         MACO JPIA final recommendations regarding the use of Public facilities was sent to Virginia Knerr and Michelle Christensen.  The Commissioners asked for confirmation of their letter to Mrs. Knerr and Mrs. Christensen regarding this matter.

§         Delbert and Ruth Hunsaker sent a letter asking for a AG exemption.  The Commissioners will notify Delbert and Ruth that they are forwarding the letter to the County Planner. 

§         Nichols and Price sent a letter requesting a release from liability since they have completed the construction of the Boat Docks at the Silo’s Bay.  The Commissioners agreed to release the liability but noted that the County now has a $183,000 asset which needs to be reported to the County’s Insurance Company for comprehensive coverage.

§         Mike Koehke sent a letter requesting a lift on Ag land for a family transfer.  The letter will be sent to WWC, the County Planner.

§         A letter from Shawn Byrant of the Bureau of Reclamation regarding the development of additional campsites at the Silo’s Recreational area.  The letter states that the County needs to get permission from the Regional Office in Denver.

§         Department of Transportation sent notification of the CTEP allocation for 2005 and 2006 in the amount of $11,889.  A copy will be sent to Brian Obert.

§         A copy of a letter to Bruce Ramsey regarding Forest Fires from Jefferson County Commissioners.

§         A letter to Gateway Economics stating that FEMA has removed the Business park  at Toston, MT and a few other properties from the flood plain.

§         Fuel tax allocation notification indicates the tax is about a $1000 higher this year.

§         Letter from Dr. Michael Nash, Compensation Group, can provide assistance in doing job appraisals.

§         2006 Montana Immigration Access Forum.

§         Lewis and Clark Humane Society sent a recap of their services to our County.  They charge the County $53 per animal.  The proposed bill for 2007 is $1696.

§         Notification of Forest Reserve monies for Broadwater County in the amount of $83,115.18.

 

Discussion item:

§         Commissioner Hohn reported on the mosquito spraying of the Fish, Wildlife and Parks area near Canyon Ferry Lake.  Apparently, there was a misunderstanding regarding the contract with Mr. Semple, the sprayer.  It’s for $8000 instead of $20,000 over the next 3 years.

§         Commissioner Hohn reported that a citizen is concerned about the Local Government Study Commission wanting a “Charter Form of Government”.  A discussion about the aspects and structure of a Charter form occurred with one prominently aspect appearing to be the right of the Charter to increase taxes at any time.

§         Terry Thrailkill, an engineer of the Belgrade area, advised Commissioner Hohn against allowing our County to getting involved with the design process of septic systems.  He told Commissioner Hohn that if the County got involved, it could be a liability against the County if the septic system failed.

§         A discussion about payment for the turn lanes for Price Road occurred.  Commissioner Hohn and Finance Officer, Natalie Tomeo, have contacted the State of Montana to obtain money through CDBG or a Intercap loan.  In both cases they were denied.  The Commissioners will contact the engineering firm and tell them that the turn lane is on hold until a funding source is found.  The Commissioners will write to DBEC explaining the situation.  However, just in case funding is found,  Commissioner Mann moved to approve the agreement with Schogia, LLC if a funding source is found.  Commissioner Hohn seconded the motion.  The motion passed unanimously.

 

Public Comments:

§         Julie Lethert, County Sanitarian, discussed the sanitation problems of the Missouri River Rendezvous Subdivision.  She stated that 76-4-113, MCA states that the Developer or owner of an approved subdivision shall provide each purchaser of property within the subdivision with a copy of the plat or certificate of survey showing the approved locations of water supply, sewage disposal, etc.  This notice signed by both the seller and the purchaser should be recorded with the Clerk and Recorder.  This would be evidence of compliance.  Julie suggested that it be recorded as an attached letter to the Deed.

§         Brian Obert of Gateway will send a letter welcoming new businesses in the County.  He reported on the Sidewalk project.  He stated that the 3rd block will start after the 4th of July.  Northwest Energy has sent the decorative lamps for the project.

 

The meeting adjourned at 3:20 pm.  The next regular meeting will be held on July 10, 2006 at 10:00 a.m. in the Commissioner’s Room of the Courthouse.
